General terms and conditions for the Kambly SA webshop
1. General
1.1 These General Terms and Conditions (hereinafter called \"Terms\") govern the relations between Kambly SA and its webshop clients. They are a mandatory component of every contract concluded between Kambly SA and a client. Additional agreements, warranties or amendments to these Terms must be in writing. These Terms apply to the ordering and delivery of Kambly SA standard articles and custom products.
1.2 The information given in the disclaimer at www.kambly.ch is an integral part of these Terms and can be adapted to new circumstances at any time.
2. Conclusion of the contract
The client's order is made online. The contract comes into being when Kambly SA sends the client an order confirmation by e-mail.
3. Changing the order
The client's order is binding on the client. Once the order has been placed, the client may make no further changes to it.
4. Login
4.1 In placing an order, the client may register on the website and open a personal account. An order may also be placed without opening an account, in which case the personal details will be used only for the processing of that order. Irrespective of the manner in which the order is placed, the data requested during login must be provided completely and accurately. Orders may be placed only by persons 18 years and over.
4.2 The personal password chosen by the client during login must be treated with the utmost confidentiality and must not be communicated to third parties. The client is responsible for all actions carried out on the website under that password, even without the client’s knowledge.
4.3 The client may at any time decline to receive advertising mail in connection with Kambly SA, either by sending an e-mail to webshop@kambly.ch or by writing a letter to Kambly SA Spécialités de Biscuits Suisse, Webshop, Mühlestrasse 4, 3555 Trubschachen.
5. Delivery terms
5.1 The client will bear the cost of delivering the articles ordered. The packing and forwarding costs are indicated in detail before the order is concluded and are shown separately on the invoice. Free shipping when you spend over CHF 100.
5.2 Kambly SA offers products on the basis of their availability. If the product cannot be delivered, the client will be informed.
5.3 Kambly SA reserves the right, at all times, not to fill orders with texts and/or images with illegal content or which are offensive in nature. The customer will be accordingly informed.
5.4 If the goods cannot be delivered or if delivery is delayed because of errors in the delivery address supplied by the customer or the absence of the addressee, Kambly SA will not be liable.
5.5 The anticipated delivery times are approximate. Kambly SA will not be liable for delivery delays occurring through no fault of its own, e.g. caused by force majeure, traffic congestion, bad weather conditions, etc., nor will these factors entitle the customer either to withdraw from the purchase contract or to claim damages. It is recommended that orders be placed early, at least ten working days before the desired delivery date. Longer package delivery times must be expected before holidays such as Easter or Christmas.

The cost of postage and packing (up to 30 kg) is CHF 12 per delivery address.

6. Prices, payment conditions
6.1 The effective prices are those shown for the offered products on the day on which the client places the order. The prices are binding until the order is confirmed by Kambly SA or for the duration stated in the order confirmation. All prices are gross prices in Swiss francs (incl. VAT).
6.2 Payment options
You can pay in the following ways:
Payment by credit card
We accept Visa, MasterCard and PostFinance.
Payment on account
When purchasing on account, the customer is obliged to transfer the purchase price to the billing institution Billset - Swisscom (Schweiz) AG. A direct payment to Kambly SA does not release the customer from their payment obligation towards Billset - Swisscom (Schweiz) AG. The customer expressly agrees that the data required for invoicing and checking their payment history may be forwarded to Swisscom (Schweiz) AG or obtained by them from third parties. Billset - Swisscom (Schweiz) AG is entitled to use information about the customer's payment history for its own purposes and to pass this on to third parties. The customer expressly agrees that the information on their payment history may be used by Billset - Swisscom (Schweiz) AG for its own purposes and may be shared with third parties such as a possible debt collection agent, credit agencies or government authorities for their own use.
7. Checking the goods / Complaints
7.1 The client undertakes to check the completeness and condition of the goods immediately upon receipt. Any complaints regarding quality and completeness must be communicated immediately to Kambly SA, in any case no later than 24 hours after delivery, failing which the delivery will be deemed to have been accepted.
7.2 Kambly SA will not be liable for damage occurring in transit and damage caused by the improper storage of the goods after receipt by the client or the client's assistants.
8. Taking back, exchanging and the right to return goods
Products delivered to the client undamaged and in a state of completeness will not be taken back or exchanged.
9. Data protection
9.1 The data required for the processing of the transaction will be stored and, in the performance of the contract, transmitted to the enterprise responsible for delivery. Moreover, with the exception of bodies responsible for checking solvency, the stored data will not be passed on to third companies. The data can be used for customer care within Kambly SA.
9.2 Order-related and other written correspondence with Kambly SA may take place electronically. Attention is expressly drawn to the security risks involved in data transmission by e-mail and which are not under the influence of Kambly SA, such as virus transmission, data corruption, data loss or access by third parties. In placing the order, the customer authorises Kambly SA to send documents and other data also via unencrypted e-mails.
10. Applicable law and jurisdiction
The relations between Kambly SA and its webshop clients are subject to Swiss law. The jurisdiction is Bern.
